Marijuana in Milwaukie
Where is marijuana allowed in Milwaukie?
In October, the city adopted a zoning ordinance (Ordinance #2134) to specify where marijuana retail stores can be located, as well as where it can be processed, stored, tested and grown. Following are current specifications:
- Marijuana retail stores are allowed in commercial and mixed use areas that are 1,000 feet from schools and other marijuana retail stores.
- Marijuana processing and warehousing is allowed in the M-TSA, BI, and M industrial zones. Processing facilities are permitted by conditional use in the BI zone.
- Marijuana testing and research is allowed in commercial and industrial areas.
- Personal, outdoor marijuana grow sites in residential areas are limited to the amounts allowed under state law.
- Medical grow sites in residential areas are required to be indoors with ventilation and odor filters.
- Recreational and medical grow/production sites, storage, testing, research, and processing facilities in industrial areas are required to be indoors with ventilation and odor filters.
- Grow/production sites are allowed in the BI and M-TSA zones by conditional-use only. Grow production sites are allowed in the M zone as a permitted use.
- Grow/production sites in the M and M-TSA zones are required to meet the following limitations:
- No more than a 10,000 sq. f.t mature plan canopy is allowed; and
- Buildings housing grow/production operations must be separated by at least 1,500 feet.

Measure 3-495
On November 8, 2016, Measure 3-495 was passed by the voters.
It imposes a 3% tax on the sale of recreational marijuana items by retailers in Milwaukie. The tax will be collected at the point of sale and remitted by the marijuana retailer. The measure also included provisions regarding collection, administration and enforcement of the tax.
