Municipal Court

The City of Milwaukie Municipal Court is the judicial branch of the City government and provides a local forum for the resolution of minor traffic violations, parking citations, minors in possession of tobacco, and violations of City ordinances. The majority of the cases heard in the Municipal Court are traffic violations.

The Oregon Legislature sets maximum and minimum fines for all traffic citations.  The fines increase with the level of the ticket. The levels are Class A, B, C and D, with A being the most serious.  There are several changes for citations written on or after January 1, 2012.  First, the dollar amount on each citation is now called a "presumptive fine".  These are supposed to be the same in every court in Oregon.  Second, these fine amounts are greatly reduced from the citations issued before January 1, 2012.  The savings is between 12% - 24%.  Third, the old schedule of assessments (taxes) which had to be added to the fine, has been changed to a flat fee of $60 per violation.  That fee is included in the fine amount, but is paid by the Court to the State of Oregon.
