Municipal Court Judges
Since 1903, Milwaukie municipal government has operated a judicial branch to enforce local statutes and regulations. For the first four decades, the elected Town Recorder was also the Justice of the Peace for "all civil and criminal matters", but with the adoption of a new City Charter in 1944, a formal Municipal Court was established and the Office of the Municipal Court Judge was created as an independent entity appointed by the City Council. As of 2014, Milwaukie has been served by 14 Municipal Court Judges.
Original Act of Incorporation - Section 28. …The Recorder shall have all the powers and jurisdiction of a Justice of the Peace in all civil and criminal matters… He shall also have original and exclusive jurisdiction of all violations of town ordinances and regulations… (adopted by the Oregon Legislative Assembly February 3, 1903)
Charter Amendment - Section 25. ...The municipal judge shall be the judicial officer of the city. He shall be appointed by and hold office during the pleasure of the council. He shall hold a court within the city which shall be known as the municipal court for the city… The municipal judge shall have original jurisdiction of all offenses defined and made punishable by ordinances of the city... (adopted by the voters November 7, 1944)
Current City Charter - Chapter VII § 28. …The municipal judge shall be a member in good standing of the Oregon State Bar during the entire term of office… the council may transfer some or all of the functions of the municipal court to an appropriate state court.
