Right-of-Way
Right of Way: Protecting and Paying for the Public’s Lifeline from Metro TV on Vimeo.
On Sep. 6, 2016, City Council adopted an Ordinance adding Title 21 to the Milwaukie Municipal Code. Title 21 requires all utilities to have a contractual agreement or a license to use the city’s right-of-way.
The goal is to accurately identify all right-of-way users and ensure fair, market-rate compensation for the use of this valuable asset.
What is a Right-of-Way?
Right-of-way is a section of land set aside for public benefit, which may include streets and sidewalks as well as land set aside for water pipes, electricity lines, telecommunications, and other utility infrastructure.
The city’s right-of-way is one of the community’s most valuable assets, and includes all property and improvements on Milwaukie’s streets. Milwaukie coordinates right-of-way use among private and public users to efficiently manage this large and complex resource.
