Deferred Sentencing Program
MILWAUKIE MUNICIPAL COURT DEFERRED SENTENCING PROGRAM
As part of our goal to make Milwaukie a safe place to drive, Milwaukie Municipal Court offers a Deferred Sentencing Program to educate drivers, promote safe driving, and reduce the number of injury-related traffic collisions in our community and surrounding areas. This program provides qualified applicants the opportunity to defer a traffic citation and earn a dismissal of their citation.
WANT TO PARTICIPATE?
If you want to participate in the Deferred Sentencing Program, follow the program overview steps listed below.
- To determine your eligibility for the program, read the Deferred Sentencing Overview and Qualifications form listed under the Supporting Documents section at the bottom of this page.
- If you qualify, complete all gray fields of the Deferred Sentencing Declaration and Agreement form located under the Supporting Documents. The court will only accept complete forms. If your form is incomplete, the court will deny your request for the program.
- Before your court date, submit the completed Deferred Sentencing Declaration and Agreement form by mail, email, or in person. If you have submitted your form to request the Deferred Sentencing program, you will not appear in court on the date printed on your citation.
- When the court has reviewed your form and your request is approved, you will be assigned a due date to pay the court fee and attend the traffic safety course. We will mail this information to you along with course registration information. If, for any reason, the court has denied your request for the program, we will call you to discuss your options.
- Your non-refundable court fee payment is due to the court no later than 30 days from the approval date and can be made in person or by mail only. You cannot make your payment online and you cannot pay before you receive the court’s approval for the program. Also, it is crucial to note that your due date may fall on a day when the court is closed. In this instance, payment must be made the day before. If the payment is received after, the payment will be considered late, and you will have failed to meet the conditions of the Deferred Sentencing program.
- You must complete the traffic safety course within 60 days from the approval date of your request for the program. To get credit for attending the course, please list MILWAUKIE MUNICIPAL COURT as the referring court. You do not need to submit your attendance certificate to the court. However, please keep the certificate for your files in case of an error in attendance reporting.
- The Deferred Sentencing program is six months from the approval date of your request. The court will check that you have complied with all the conditions of your signed Declaration and Agreement at the end of your program. If you meet all the conditions, the court will withdraw your No Contest plea and dismiss your citation.
