ADA Transition Plan for Accessibility in the Public Right-of-Way
The Americans with Disabilities Act (ADA) protects individuals from discrimination on the basis of disability. Title II of the ADA applies specifically to all public programs, services and facilities, including the public right-of-way (ROW) which is the particular focus of the transition plan discussed here. Public entities must complete a self-evaluation to determine whether they are in compliance with ADA standards and regulations, thus a new comprehensive evaluation of sidewalks and ramps is being conducted throughout the City of Milwaukie to determine the extent of the ADA accessible pedestrian environment. The process of inventorying sidewalks and ramps will be ongoing and continuously updated as improvements are made. As part of the ADA public participation process, City Council designated the Public Safety Advisory Committee as Milwaukie's Community Planning Advisory Council. The City’s goal is to be accessible to all of the public, including individuals with disabilities.
The transition plan includes all the steps needed to reach ADA compliance throughout the City over the next 25 years. All improvements in the right-of-way must meet ADA standards for ramp configuration and sidewalk width and cross slope. Combined, these pathways are known as the Pedestrian Access Route (PAR); the PAR must provide a pathway free of barriers (such as mailboxes, signs, and poles) wide enough to allow access for persons with disabilities. Sidewalks servicing entities covered by Title II will be given priority in the improvements schedule. Approved Requests for Service will be addressed according the the severity of the noncompliance.
The Engineering Department has been inspecting streets throughout the city and recording the current state of the ROW in a geographic information system (GIS) database. The inventory is available through the map found in the Supporting Documents, which is periodically updated as improvements are made and more sidewalks are inventoried. The Americans with Disabilities Act Transition Plan for Accessibility in the Public Right-of-Way was adopted by City Council on June 19th, 2018. If any member of the public has a concern about ADA compliance in a particular location, they can complete the Request for Service Form. The completed form must be submitted to the Engineering Department for review, after which the applicant will receive written notice of a proposed course of action.
